Dru-g Case: Court Fixes Date For Ruling On Abba Kyari’s Request | READ DETAILS

A Federal High Court sitting in Abuja, on Monday, March 14, resumed hearing on the suit against suspended Deputy Commissioner of Police (DCP) Abba Kyari.

Kyari and his co-defendant, Sunday Ubua, an Assistant Commissioner of Police (ACP), who are facing charges bordering on alleged drug deals appeared before Justice Emeka Nwite for a bail request.

Recall that on March 7, the duo alongside; Bawa James, an Assistant Superintendent of Police (ASP); and Inspectors Simon Agirgba, and John Nuhu; Chibuna Umeibe and Emeka Ezenwanne, were arraigned by the NDLEA on eight count charges. However, Kyari and Ubua pleaded not guilty to the charges.

At the resumed hearing on Monday, the NDLEA prayed the court to deny Abba Kyari, bail. According to the Agency, Kyari would escape the country and be unavailable for trial if granted bail.

The Director, Prosecution & Legal Services, NDLEA Mr. Joseph Sunday, also argued that Kyari has the capacity to interfere with its witnesses and as such, should not be released from custody.

The Prosecution counsel told the court that bundles of exhibits marked NDLEA 1 to 5, where attached to the counter-affidavit.

However, Kyari, in his bail application that was moved by Mr. Mahmud Magaji, SAN, prayed the court to grant him bail on liberal conditions.

Arguing that the charge against him contained bailable offences, the embattled DCP, urged the court to invoke the powers donated to it by the 1999 Constitution, as amended, to exercise discretion in his favour.

Meanwhile, while the 2nd, 4th and 5th Defendants, through their respective lawyers, also prayed the court to release them on bail, pending the determination of the case against them, the 3rd Defendant, applied for time to respond to a counter-affidavit the NDLEA filed in opposition to his bail request.

Justice Nwite adjourned the matter till March 28.
