A legal practitioner in Aba, Abia State has sued the Abia state government and Track Care Nigeria Global company limited, the contractor handling some government road constructions in Aba over open drainages(gutters) it constructed at Aba-Owerri Road, Umungasi and Umuatako which has become a dead trap to pedestrians and users of the road. In a case filed by Barr. Emperor Ogbonna of Chief G. E.O law firm before the Abia state High court, Osisioma–Ngwa division on the 16th of December,2021. The victims are claiming a damage to the tune of two billion naira (#2,000,000,000,000) for losses and injury suffered.
A review of the case file sited by ALL FACTS NEWSPAPER, the legal practitioner Barr. Emperor Ogbonna claimed that his client Mrs Okoro fell into the gutter and was almost killed. He claimed that she had to stay in the hospital for several months, battling to save her life. Apart Mrs Okoro ,he said another of his client ,Mr Obisike Paul, equally fell into one of the gutters. He adduced that the construction company and indeed the Abia State government that contracted them to do the job did not provide adequate safety measures to stop pedestrians from falling into the gutter. According to him, due to this negligence his client almost lost his life and the doctors at Rosevine Hospital had to battle to save his life.
The legal practitioner stated that as an activist, he cannot allow this to continue. He revealed that several people are either losing their lives or losing their limbs because the government has failed to do the right thing. He pointed out that nobody is against construction, “but all over the world, there are rules of engagement and construction companies provide safety measures, warnings and items to stop people from being killed at constructions sites”, he added.
Pursuant to the above, the law firm said it decided to sue the Abia State government and Track Care Nigeria Global Company Ltd, being the construction company doing the job, and is demanding a two Billion Naira damage, over their negligence which almost caused the death of Mr Obisike Paul. He prayed that justice shall be done and most importantly, the legal practitioner said he is hoping that any company doing construction work in Abia state shall observe safety measures and shall not leave the gutters uncovered and most importantly again, shall do the work in a manner that the people shall be alive to enjoy the job done.
