A High Court of the Federal Capital Territory, has ordered one Innocent Destiny, to wash a public toilet in Mpape Park, Abuja for 60 days for attempting to defraud clients on messaging platform known as WeChat.
Destiny was accused by the Economic and Financial Crimes Commission (EFCC), of parading himself as a female by the name Kim Webber and inducing male users of the platform with a motive to defraud them of their money.
Counsel to the EFCC, Ijeabalum Diribe who argued that the act violated section 322 of the penal code, prayed the court to convict and sentence the accused according to the terms of the plea bargain entered on June 22, which stated that upon conviction he would spend a month in prison or pay a fine of N100,000.
However his counsel, Holy Nuhu prayed the court to temper justice with mercy considering that the defendant was young and a first-time offender with no criminal record.
In his ruling on Monday, July 19, Justice Kezziah Ogbonnaya gave him a non-custodial sentencing of washing public toilets.
The judge mentioned that the sentencing will help with de-congestion of the courts.
