The Aba North/South Federal Constituency tribunal sitting in Umuahia, Abia State has struck out the petition filed by PDP Aba North/South Federal Constituency candidate for the 2019 general election stating that the candidate can not blow hot and cold at the same time by claiming that the rerun election of 9th of March 2019 was null and void even as he participated in it.

It should be remember that Honorable Uzo Azubuike who was the candidate of PDP in that said election, filed a petition challenging the victory and declaration of Honorable Prestige Ossy the APGA candidate in that election.

In the petition, the petitioner claimed that the rerun election held by INEC was null and void because he won the election in the first instance on the 23rd of February 2019 but that INEC refused to compute his results.

In the ruling by the tribunal, the tribunal judges stated that the may fact that Uzo Azubuike participated in the rerun election, he has waved his right to challenge the validate of the rerun election and based on that, the rerun election is valid and stands correct.

The tribunal also ruled that Uzo Azubuike failed to prove why, how and when the election results from the said cancelled units where he claimed he won was not collated despite calling numerous witnesses.

On a final note, the tribunal ruled in favour of Honorable Prestige Ossy, striking out the petition by Honorable Uzo Azubuike.
