A Federal High Court sitting in Abuja has ordered the Department of State Service (DSS), to produce the 12 arrested aides to Yoruba activist, Sunday Adeyemo aka Sunday Igboho.
The presiding judge, Justice Obiora Egwuatu gave this order on Friday, July 23, adding that the aides are to be produced in court on or before the next adjournment, Thursday, July 29.
He also ordered the DSS to show cause, why the applicants should not be admitted to bail.
The detainees are; Abdullateef Ofeyagbe, Amuda Babatunde (alias Lady K), Tajudeen Erinoyen, Diekola Ademola, Abideen Shittu, Jamiu Noah, Ayobami Donald, Adelabe Usman, Oluwapelumi Kunle, Raji Kazeem, Taiwo Opeyemi and Bamidele Sunday.
Recall that following the raid on Igboho’s house and the arrest of his aides, Barrister Pelumi Olajengbesi filed a suit against the DSS and its Director-General, Yusuf Bichi.
Olajengbesi requested for a court order “mandating and compelling the respondents to produce the applicants” to enable the court “inquire into the circumstances constituting grounds of their arrest and detention” since July 1, 2021 and where it seems fit grant applicants bail.
And also to “show cause as to why the applicants should not be granted bail in accordance with the provision of section 32 of Administration of Criminal Justice Act 2015 and other extant laws in Nigeria.”
Olajengbesi had argued that the applicants are citizens of Nigeria with inherent rights.
