Center For Equity, Eradication Of Rural Poverty, Petitions President Of Appeal Court Over Suit Filed By Abia Labour Party
Sir Don Ubani, the Director of the Center For Equity and Eradication of Rural Poverty, and a former deputy chief of staff to ex-Governor Okezie Ikpeazu of Abia state, has petitioned the President of the Court of Appeal, seeking action on the appeal suit filed by the Abia state chapter of the Labour Party over a judgment made by Justice M.N. Yunusa of a Federal High Court in Kano state.
Ubani in his petition noted that the mandatory 67-day window period of appeal has elapsed and exceeded in the appeal suit no: CA/KN/101/M2023 filed by the Labour Party, adding that hence the appeal has neither been heard nor disposed of, it contravenes the provision of the 1999 constitution.
“Section 285 (12) of the 1999 constitution of the Federal Republic of Nigeria as amended, clearly stipulates that an appeal from a decision of a court in a pre-election matter shall be heard and disposed of within 60 days from the date of filing of the appeal” the petition read in part.
Ubani informed the President of the court of appeal that the appeal suit in question is 97 days gone as at August 31, 2023 and demanded that the President make a declarative statement that the appeal was neither heard nor disposed.
Recall that the Labour Party in Abia state had filed an appeal over the judgement given by the Kano Federal High Court in the suit filed by one Ibrahim Haruna against Labour Party and INEC.
Ubani’s petition has been received by the President’s Chambers, Court Of Appeal, Abuja.
