In an earlier press release sent to AFNEWS, the National Publicity Secretary of APGA, Barr. Tex Okechukwu had claimed that Mr. Smart Ihuoma was expelled from APGA in 2019. In that same press release, he dissociated APGA from any comment made by Smart Ihuoma.

But in swift reaction, Mr. Smart Ihuoma has maintained that he remains a member of APGA and the authentic Ag. National Treasurer of the party.
In a press release signed by Smart Ihuoma, he revealed that the Oye led APGA leadership tenure expired long ago and that a High Court in Kwale Delta State affirmed the position.

Oye and his former NWC were sacked by a Kwale High court of Delta State last year. It is common knowledge that every position,whether elective or appointment has a life span and APGA is no exception.
The party Constitution clearly stated how and when elections into various positions of the party is to be conducted. You need to seek reelection into an office you are occupying within the period of your current tenure and not after the expiration of your current tenure.
In other words, congresses for Ward,LGA and State offices should have taken place before the 15th May, 2019 when the tenure of the then officers of the party would have expired.
Instead,the congresses were conducted on the 19,21 and 23 of May,2019 without the former leadership taking into cognizance,the provisions of Articles 19(6)&(7) of the party’s constitution.
This act by implication ,meant that all those elected under such circumstance were illegally elected and can not function as valid officers of the party.
A Federal High Court was approached by the current Ag. National Chairman of APGA, Dr. Mic Adams to halt the congresses because they violated the Constitution of the party. An interim order stopping the Congresses was given.
Oye and his group rushed to procure an Order from Ibadan High court empowering them to conduct the congresses on or before 15 may,2019. Because He(Oye) ran the party like his private business concern,he failed to adhere to the instructions of his own order from Ibadan.
He conducted his Congresses on the 19,21 and 23 of May 2019. This by implication,nullified all he did. His not putting up appearance before the Kwale High Court,warranted the Court to nullify his congresses.
Dr. Adams and his group for which I am the Ag. National Treasurer dully understand the implication of Victor Oye’s action and it’s impending danger had to constitute an interim management team that would run the party pending when properly convened congresses and convention is conducted .
A scenario played out in Kwale,the Judge who gave a Judgement sacking Oye and his group,had to set aside his judgement the eve to the day of his retirement from service which raised a lot of questions.
As law abiding citizens,we proceeded to Appeal Court and the Victor Oye who claimed to have been validly elected is adopting delay tactics while he has been sending emissaries to the Ag. National Chairman,Dr. Mic Adams for settlement.
All we presented before the High Court in Kwale is still what we have presented to the appeal court which granted our request for accelerated hearing last week. It is on record that,Victor Oye’s led former NWC conducted the worst party primaries in the history of party primaries in Nigeria.
The events of 2018 primaries of the party under the former NWC caused a lot of members of the party to approach the Court for redress. Those who were duped had petitions submitted to the EFCC.This has caused APGA so much as a lot of very credible persons have since dumped the party.
I became a member of APGA in 2007 whereas,the former chairman,Victor Oye became a member of APGA on the 6th of June,2015,the very day Gov. Obiano made him chairman. He can’t lay claim to the chairmanship of the party as that is a subject of litigation before the Appeal court. The interim management committee of the party is still in place until validly convened congresses and convention is conducted. I shall send you copies of the Court Order and Judgement that sacked the former NWC of APGA.
