The Federal High Court sitting in Umuahia on Friday took the preliminary objections filed by the defense council of All Progressive Congress (APC) and Hon. Emeka Atuma who are the 1st and 3rd Defendants.
ALL FACTS NEWSPAPER had reported that the member currently representing Ikwuano/Umuahia North/South, Hon. Samu Onuigbo had approached the court to uphold the APC Abia Central Senatorial primary election which was conducted and won by him on 28th May 2022. (READ HERE)
However, making its case before the court, the counsel to the to Atuma, Isaac Anya, argued that some of the results and documents relied upon by the plaintiff were documents that are not helpful to the plaintiff’s case, adding that “You cannot say that a primary election of a party was conducted on the 29th of May and your result is bearing 28th of the same month”
Anya in his further argument stated that the INEC result presented by the plaintiff is undaunted and therefore should be struck out for lack of merits.
Emeka Obegolu who serves as the counsel for Onuigbo, prayed the court to uphold the election result of the plaintiff against what he termed “impunity committed by the APC” in trying to deprive his client of the victory he duly won during the party’s senatorial primary of Abia Central.
“We believe that the court will grant justice to Samuel Onuigbo and order that his name be published by INEC as the candidate for Abia Central senatorial candidate for the 2023 election.
Obegolu stated that the 2nd defendant which is the Independent National Electoral Commission in their report admitted that they monitored the primary election which took place on the 28th and 29th of May which Onuigbo won which interestingly has not been countered by any of the parties.
Justice Evelyeen Anyadike who presided over the case adjourned it to October 4th.
