ONYEKWERE AKYM UCHE (OAU) RUNNING FOR GOVERNOR ABIA STATE IN 2023

The Action Alliance saga; the Birth of The New Abia

The Court of Appeal sitting in Abuja judicial division with Motion No: CA/ABJ/PRE/ROA/CV/821M1/2022 in a suit no: FCT/HC/CV/174/2022, issued an order granting Applicants to the suit Leave to appeal as interested parties against a judgment of the High Court of the Federal capital territory. The order was issued on Monday September 5th, 2022.

Prior to this order, in the Court of Appeal in the Abuja judicial division held in Abuja. On January 7th, 2022 with Motion No: CA/ABJ/CV/879/2021. An appeal against the judgment of the FCT High court delivered on November 1st, 2021 in suit No FCT/HC/CV/1734/2021, we refer to pages 34 and 35 of the last paragraph. Wherein the Court of Appeal justices stated amongst other things, that the suspension of Kenneth Udeze or his expulsion from membership of the Action Alliance has not yet been lifted by the appropriate authority or set aside by a court of competent jurisdiction, thus the suspension has stood valid.

Over the time, the Action Alliance political party had been engaged in an internal conflict where Kenneth Udeze and his cohorts tried to sabotage and obstruct the Party’s objectives and processes.  He was suspended, thereafter expelled from the party on grounds of obstruction of the party’s rule of law and anti-party activities. He challenged the termination in court and the court upheld his termination having complied with the rules and regulations. Also, in compliance to the Electoral Act. On the appeal against his termination the Court stated that,

“It found merit in the preliminary objection. The originating Summons is an abuse of Court process. It is baseless and one suit too many on the same issues previously canvassed in the other Courts of coordinate jurisdiction for which the Court’s decision were effectively against the present claimants (Kenneth Udeze). This action or suit is therefore terminated in lime (sic)”.

Kenneth Udeze was expelled from Action Alliance (AA), thereby ceased to be recognized as the party’s national chairman. Any business or events conducted at the time of his expulsion in the name of the party (AA) remains null and void. The convention held by the Kenneth Udeze faction was illegal on grounds of nullity of membership and lack of authority.

The OAU 2023 campaign registered with the Action Alliance (AA) with the intent to run for office of the governor of Abia State in 2023. The principles and ideology of the OAU organization aligns with Action Alliance, it was a perfect match made in heaven. At the convention all other aspirants at the time consolidated their support to OAU who emerged as a consensus candidate. Mr. Onyekwere Akym Uche (OAU) became the flag bearer for AA to contest for Governor of Abia State in 2023.

The nomination and vote for Mr. Onyekwere did not go unnoticed by Kenneth Udeze and his faction, they devised an ulterior plan to rattle and discombobulate the party, alongside OAU’s candidacy. There have been several mediation meetings initiated by the party to reconcile and come to terms in achieving a common goal. Kenneth Udeze and his faction refused to engage, because from all indication and assessment they have no genuine interest for the party other than create chaos and destruction. The OAU organization believes that the interest of Abia State is the best interest of the organization and the party, unity and togetherness will provide optimal result rather than division. Efforts were made to integrate the warring faction back to the legitimate group/party, yet they remain obdurate and unwilling.

In another developing news, the Federal High Court sitting in Abeokuta, the Ogun State capital on Thursday awarded #1million against the Kenneth Udeze faction. The Adekunle Rufai Omo-Aje (Legally recognized) faction of AA equipped themselves with the Court of Appeal judgment, whereas that of the Kenneth Udeze faction allegedly presented fraudulent judgment of the High Court before the court. This development prompted the court to award the cost against Kenneth Udeze’s faction of the party. The court held that the Court of Appeal judgment that upheld the suspension and expulsion of Udeze and his non recognition as AA national chairman has not been appealed. The court declared that the Court of Appeal judgment is superior to the judgment of the FCT High Court.
