Gov, Okezie Ikpeazu and the other two tiers of government in Abia state have been dragged to the court by an Abuja based Legal Practitioner, Obi C. Nwakor Esq. over the appointment of caretaker/transition committee chairmen for the 17 local government areas of the state.
In suit filed by Mr. Nwakor against the government of Abia state in No HU/2/2020, the lawyer is asking the court to nullify the appointment of caretaker/ transition chairmen and their deputies by the government of Abia being undemocratic and unconstitutional in the face of the Supreme Court decision in Eze v Governor Abia State (2008)15 NWLR (pt 2014) and (2014) 5-6 (pt 1) 171.
Based on the court papers made available to AFNews, Barrister Nwakor is asking the court to order for an immediate election into the 17 local government areas of Abia state.
In the court process, the legal practitioner is also claiming damages of Two Hundred Million Naira from the government for breach of his right to contest the position of the local government chairmanship of his local government which is Umunbeochi LGA by the appointment of non elected caretaker/ transition committee chairmen.
One hundred million naira as general damages against Gov. Okezie Ikpeazu, Government of Abia State and the Attorney general of Abia State, while the other One hundred million naira as exemplary, punitive and/or aggravated damages still against Gov. Okezie Ikpeazu, Government of Abia State and the Attorney general of Abia State.
