How to Recall Lawmakers in Nigeria: INEC Releases New Guidelines

The Independent National Electoral Commission (INEC) has released new guidelines empowering voters to recall lawmakers. Constituents can now initiate the process to remove their representatives from the National Assembly, State Assemblies, and area councils in the FCT, following the detailed procedure set by INEC.

The Independent National Electoral Commission (INEC) has taken a significant step in empowering voters by releasing new guidelines on how to recall lawmakers from both the National Assembly and state legislative chambers. In a statement issued by INEC Commissioner Sam Olumekun, the commission acknowledged receiving numerous requests from constituents across the country who are seeking the recall of their elected representatives.

Olumekun revealed that many groups have been approaching INEC to initiate the recall process on their behalf. However, he clarified that the process must be initiated by the voters in the lawmakers’ respective constituencies. INEC’s role is to implement the voters’ request, strictly adhering to the constitutional provisions outlined in Sections 69, 110, and 160 of the 1999 Constitution (as amended), as well as Sections 2(c) and 113 of the Electoral Act, 2022.

“For clarity, the process is initiated by the voters in a constituency,” the statement emphasized. “The Commission only implements their request in line with the legal framework provided by the Constitution and the Electoral Act.”

The electoral body has now uploaded a 10-page document detailing the full procedure for initiating the recall of lawmakers. The document is available on INEC’s website and social media platforms to guide prospective petitioners.

With the release of these revised regulations, INEC is urging constituents to carefully follow the laid-down procedure to submit their petitions effectively. These guidelines provide a roadmap for Nigerians who are dissatisfied with the performance of their representatives and wish to remove them through a democratic process.

This latest move by INEC reflects the increasing demand for greater accountability in governance. The new recall guidelines come at a time when voters are becoming more active in holding their leaders accountable for their actions, signaling a potential shift in the relationship between Nigerian lawmakers and their constituencies.
