Court Declines Abba Kyari, Four Others Fresh Bail Application |Read Why

Suspended Deputy Commissioner of Police, Abba Kyari and four others has been declined bailed application.

Ruling on the application on Tuesday, Justice Emeka Nwite of the Federal High Court in Abuja said that the applicants failed to present sufficient materials and evidenced to warrant the granting of fresh application.

He held that the development the defendant relied upon did not fall within the purview of sections 162 and 163 of the Administration of Criminal Justice Act, ACJA, 2015, to warrant the court to vary its subsisting order.

More so, Justice Nwite held that since the NDLEA has not closed its case, both Kyari and his co-defendants could interfere with some of the vital witnesses or undermine their prosecution, if released on bail.

Kyari and four others are standing trial on allegations that borders on hard drug trafficking offences preferred against them by the National Drug Law Enforcement Agency (NDLEA).

The NDLEA had, on March 7, arraigned Kyari (1st defendant) and six others on allegations bordering on a cocaine deal.

He was arraigned alongside four suspended police officers including ACP Sunday Ubia, ASP James, Inspector Simon Agirigba and Inspector John Nuhu as 2nd to 5th defendants respectively.

Justice Nwite, therefore, reaffirmed his earlier ruling of March 28, 2022 ordering an accelerated hearing.
