A court sitting in Abuja on Monday, discharged four out of six protesters arrested in November 8, 2020 for demonstrating outside the National Assembly.
The six defendants were arrested last year by the police following the EndSARS protest that rocked the country.
Defense lawyer Henry Akwaji, requested that the case be dismissed because the prosecution team was absent from court on Monday. Also pointing out that they were absent during the hearing of the defendant’s bail application on November 11, 2020.
The chief magistrate’s court in Wuse zone 2, gave her ruling, terminating the case against four of the defendants on the ground of lack of diligent prosecution of the case by the police.
“Defendants, Olutosin Adeniji, Abdusalam Zubarur, Paul Akinwumi, and Devour Chomo are discharged and the complaint against them dismissed.” magistrate Musa Eneye ruled.
According to Awaji, the remaining two, Yasidu Bashiru and Kabiru Garzali, were absent from court due to ill health and are said to be receiving traditional treatment in Kaduna.
Reacting, the magistrate Musa Eneye said there was no medical report to support the claim of ill health status of the two defendants.
The case against Yasidu Bashiru and Kabiru Garzali was adjourned until March 24.
