Renowned human rights lawyer and Senior Advocate of Nigeria, Femi Falana, has dragged Mark Zuckerberg’s Meta Platforms Inc. to court, demanding $5 million in damages over what he describes as an invasion of his privacy.
Falana filed the lawsuit at a Lagos High Court through his legal representative, Olumide Babalola. He alleges that Meta, the parent company of Facebook, wrongfully published a misleading video linking him to a false health condition. The video, titled “AfriCare Health Center,” falsely claims that Falana has been battling prostatitis for over 16 years.
According to Falana, the video, which contains both his name and image, violates his fundamental right to privacy as guaranteed by Section 37 of the Nigerian Constitution (1999) and the Nigeria Data Protection Act (2023).
The Legal Battle: Falana’s Claims Against Meta
Falana argues that the publication of the video on Facebook is “false, misleading, and unfair,” causing him emotional distress and reputational damage.
In his affidavit, he states that he has never suffered from prostatitis and has no association with the page or video. The lawsuit seeks a court order mandating Meta to immediately remove the content and permanently erase all related materials.
Furthermore, Falana claims that Meta’s failure to verify the authenticity of the content before publishing demonstrates negligence, recklessness, and a lack of ethical responsibility. He insists that the publication was designed to generate traffic and boost advertisement revenue at his expense.
Meta’s Global Reach and the Impact of the Alleged Falsehood
The senior advocate emphasized that Meta operates on a global scale, and any content published on its platform is accessible to millions worldwide. The video in question has reportedly been viewed by a vast audience since January 2023, further exacerbating the damage to his reputation.
Falana insists that the publication has painted him in a false light, exposing him to ridicule, anxiety, and emotional distress. He describes the publication as an unjustifiable intrusion into his private life.
Falana’s Legal Demands
In his lawsuit, Falana is seeking:
A declaration that Meta’s continued publication of his name and images in the video constitutes a breach of his fundamental right to privacy.
An order compelling Meta to delete the video from all its platforms.
General damages amounting to $5 million for the emotional, psychological, and reputational harm caused.
Any other consequential orders the court deems necessary.
